Being in a car accident is a potentially traumatising and upsetting experience, whereby people can sustain injuries. But these are not exclusive to the drivers of the vehcile/s involved. Passengers of car accidents can also sustain injuries and are able to make a claim if they were injured.

But unlike drivers of vehicles, passengers can not be at fault for road traffic accidents. This means they are able to recover the full amount of damages because nothing was their fault.

If you were a passenger in a car accident, you could be able to make a claim against:

  • The driver of the car you were in
  • The other driver
  • Both drivers

Making a claim against the driver of the vehicle you were in

As a driver, you are responsible for the safety of your passengers. Meaning that, if you were in a car accident, and it was the driver’s fault in the car where you were a passenger, then as a passenger you can make a claim against the driver.

Making a claim against the driver of another vehicle where you weren’t the passenger

If the car accident you were involved in was clearly the fault of another driver where you were not the passenger, a personal injury claim can still be made against the other driver.

Making a claim when the fault is unknown

As a passenger, it is not your responsibility to ensure the safety of anyone in the car, and therefore do not need to be paying attention to drivers, and the road. The police and insurance companies of the drivers involved will make a decision as to who was at fault for the car accident. Either way, you are still able to make a claim against a party, even if you are unsure of who is at fault.
