Buying a new home can be stressful, and choosing the right solicitor for your conveyancing helps to make sure that the process is as smooth as possible. Conveyancing is the process of preparing legal documents for a property sale. There are many things to consider when choosing your solicitor for this important role.
What does a solicitor do?
Solicitors handle the legal aspects of purchasing a property, including:
- Handling contracts
- Giving legal advice
- Carrying out local council searches for your property
- Dealing with the land registry
- Transferring the funds to pay for your property.
They can deal with those legal issues that can arise during the property purchase.
When conveyancing a new build purchase, there are several other important jobs that they carry out:
- Checking that appropriate planning permission has been granted
- Highlighting any restrictive covenants on the property (these could prohibit alterations to the property)
- Explaining whether the property is leasehold or freehold, and what that means for your specific property.
What should you take into account when choosing your new home solicitors?
- Advice from friends and family
Word of mouth is great for choosing a solicitor. Just remember that what worked for them may not work for you.
- Fees
Of course, fees are an important consideration, particularly when purchasing a property is so expensive. Make sure that the fees you have been quoted are clear. Solicitors can charge in different ways, for example, a fixed fee, an hourly fee or a percentage of the property price. Remember that it’s not always best to go for the cheapest – you want a quality service too! Look out for hidden costs too.
- Communication
Communication is very important during the purchasing process. Finding out the best times and ways of contacting a solicitors is an important way to relieve a lot of stress! However, it is worth bearing in mind that the process can take a long time, and although you will want to be updated regularly, sometimes there is simply no news.
I’ve made an offer – what now?
It is a good idea to instruct your solicitor as early as possible in the process. That way, they can handle any issues you have throughout. When you have decided on your solicitor, first make sure that they are listed on the Law Society register. Your solicitor will be able to help you with all sorts of aspects of the purchase, and advise you if things go wrong (for example, gazumping, boundary disputes or your mortgage offer falling through).
My estate agent recommended a solicitor – should I use them?
You can, but make sure you do your research first. Estate agents often recommend a local solicitor, but this may be because they are receiving a large commission! This in turn can mean that your bill ends up higher. Make sure that you get a quote before you agree to use their services.
